以日本《裁判员法》的制定、颁布和施行过程为分析对象,我们发现日本的刑事司法改革注重吸收普通民众的参与。这种公民参与司法的理念对于当下中国的刑事司法改革特别重要,在中国未来参与改革的主体、改革方式以及改革路径的选择方面都有极大的借鉴意义。
Taking Japan’s “Referee Law” formulation, promulgation and implementation process as the analysis object, we found that Japan’s criminal justice reform focused on absorbing the participation of ordinary people. This concept of citizens’ participation in the judiciary is of particular importance for the current reform of criminal justice in China. It is of great reference to China’s future participation in the reform of the main body, ways of reform and the choice of the reform path.
