法律全球化特别是西方法律全球化的时代背景,引发了中国社会甚或非西方社会中法秩序的二元化:一个是名义上居社会生活主流、整体上来源于西方的国家法秩序,另一个是实际上居社会生活主流却“上不了台面”的、源自于历史传统的民间法秩序。从场域公共秩序逻辑角度所建构之法律全球化背景下的民间法哲学论纲,确立了一种像国家法主体思维一样的民间法主体思维,主张:当下中国法治秩序状态的真正实现不能仅仅倚靠国家法及其所支撑的国家法治秩序,还要仰赖民间法及其所支撑的民间法治秩序;是为法律全球化背景下的中国法治二元观。
The globalization of law, especially the background of the globalization of western law, has triggered the dualization of legal order in Chinese society and even in non-Western society. One is the mainstream of social life in name and the whole is derived from the western state law and order. From the perspective of the logic of public order in the field, the outline of folk legal philosophy in the context of legal globalization establishes a subjective thinking of folk law as the subjective thinking of state law. It holds that the real realization of the status quo of the rule of law in China can not be achieved by mere formality Relying on the state law and the law and order it supports in the country, it also depends on the civil law and the order of civil law supported by it; it is the dual view of the rule of law in China in the context of legal globalization.
