行政是行政法学的研究核心,现代行政以公共性为显著特征。行政的独立和公民社会的形成是行政公共性出现的前提,在给付国家时代行政公共性特征得以进一步展示,这也是宪政国家的客观要求。行政公共性特征主要体现在行政权力主体的多中心化、行政公开制度化和行政相对人参与的普遍化以及公共利益是行政公共性的价值导向。
Administration is the core of administrative jurisprudence. Modern administration is characterized by its public nature. The independence of administration and the formation of civil society are the preconditions for the appearance of administrative publicity. The administrative publicity features can be further displayed in the time of paying the state, which is also an objective requirement of the constitutional government. The characteristics of administrative publicity are mainly reflected in the centralization of administrative power, the institutionalization of administrative openness, the universalization of the participation of the administrative counterpart, and the value orientation that the public interest is the administrative publicity.
