双方自愿的前提下缔结的合法有效的,长时间的共同生活,双方互相享有权利并且履行应该履行的义务的关系就是有效的受法律保护的婚姻。婚姻关系的好坏与当事人的利益之间有之间的联系,子女、家庭与社会的利益都在其中,所以,确认和保护依法成立的婚姻关系是民法所要调整的主要的民事关系。婚姻纠纷若能得到良好的法律处理,能够合理的保障当事人的婚姻权益、婚姻效力并制裁有关的违法婚姻。于2012年对民法中的《婚姻法》进行了进一步的修改,以便能够很好的适应社会的变化,进而更好的调整在当下社会环境下的婚姻制度。
The lawful and effective long-term co-existence concluded on the voluntary premise of both parties is an effective legally protected marriage in which both parties enjoy their rights and fulfill their obligations. The relationship between the quality of the marriage and the interest of the parties are related. The interests of the children, the family and the community are all included. Therefore, the identification and protection of the marital relationship established by law are the main civil relations to be adjusted by the civil law. If a marriage dispute can be properly handled by the law, it can reasonably protect the marital rights and interests of the parties, the effectiveness of the marriage and sanction the related illegal marriage. In 2012, the Marriage Law of Civil Law was further amended so as to be able to adapt well to changes in the society so as to better adjust the marriage system in the current social environment.
