承包商协助业主融资的法律风险及防范对策

近年来,随着宏观经济形势的持续低迷、银根的日趋收紧,工程项目尤其是房建项目融资越来越难。承包商或者出于承接工程目的,或者出于加快收款考虑,往往会应业主和金融机构的要求,对业主的融资加以协助。笔者结合常见的形式,对承包商协助融资可能引发的法律风险加以分析并提供应对建议,供承包商企业操作参考。一、承包商协助融资的几种常见形式及其法律风险1、协助签署与实际履行的合同内容不完全一致的总承包合同具体做法:建设工程项目融资过程中,为了证明贷款资金用途,银行和其他金融机构通常都会要求业主提供总承包合同文件。业内周知的是,项目管理实践中,业 In recent years, with the continuous downturn of the macroeconomic situation and the tightening of monetary policy, financing of construction projects, especially the construction of housing projects, has become increasingly difficult.
