提存公证具有消除疑虑、减少纠纷、提高效率和维护经济与社会正常流转等作用。是清偿债务的一种特殊方式。它是指当债务人因债权人的原因而无法向债权人履行给付债务时,债务人可将有关物(物币)提交于提存机关(如公证处)。由提存机关负责收存并交付给债权人,从而免除债务人的给付义务和风险责任。提存公证是指公证机关对提存法律行为的真实性、合法性给予证明。
Withdrawal of notarization has the effect of eliminating doubts, reducing disputes, improving efficiency and safeguarding the normal circulation of economy and society. It is a special way to pay off debts. It means that when the debtor can not pay the debts to the creditors due to the debtor’s reason, the debtor may submit the relevant things (monetary assets) to the depositary organ (such as a notary office). The depositary authority shall take charge of the deposit and deliver it to the creditors, thus relieving the debtor of the obligation of payment and risk responsibility. Notarization refers to notarization of the depositary legal action to prove the authenticity of the law.
