封建专权时期,最高统治者为巩固统治常常出台一些笼络安抚、听取百姓疾苦的措施,直诉制(上访制)即其中之一。直诉制的意思是,某些重大案情和冤屈莫申者,觉得自己的正当利益被误判而受侵犯时,可超出一般诉讼管辖和诉讼程度之范围,直接向最高统治者申诉(类似“上访”),以达到缓和社会矛盾的目的。
