2005年10月20日,香港旅客陈某欲乘班机从某国际机场出境前往香港,未向海关申报任何物品。但A海关在随机检查中发现其行李箱中装有用旧衣服包裹的青印花芒口碟、碗各1件,青花三足炉1件。A海关将上述物品暂扣并提请该省的国家文物出境鉴定站进行鉴定。经鉴定,陈某携带的青印花芒口碟、碗的朝代是南宋,为国家三级文物,青花三足炉为明朝文物,均属国家禁止出境文物。2005年12月28日,A海关根据《中华人民共和国海关行政处罚实施条例》第二十条的规定,决定没收陈某携带出境的上述文物。陈某不服该行政处罚决定,于2006年1月16日向A海关的上一级海关提起行政复议申请。
