美国学者努斯鲍姆提出“诗性正义”的命题,并论述了它的三个特征:“走向他人”的重要性、在人性上“保持丰富性”的必要性以及“诗性裁判”的可能性。她用“诗性正义”去纠正经济活动与司法活动中忽略人的情感的偏向,证明文学想象是有益于公共生活的。这一观点引发了争议,批评者认为文学的情感特性决定了它极有可能损害公共生活的公正性。笔者认为,在涉及人的生命活动时,情感的准确性往往比理性的准确性更高一级,不是情感服从理性推进了生命的发展与丰富,而是理性服从情感推进了生命的发展与丰富。文学恰恰是凭借自身对于人的生命与情感的重视而成为人类正义事业的一部分的,离开这个基点,文学便失去了作用于正义事业的有效途径与方法。
The American scholar Nussbaum proposed the proposition of “poetic justice” and discussed its three characteristics: the importance of “going toward others”, the necessity of “keeping richness” in human nature and “Poetic referee ” possibility. She uses “poetic justice” to correct the bias of neglecting human emotions in economic activities and judicial activities, and proves that literary imagination is beneficial to public life. Literature is precisely by virtue of its own emphasis on human life and emotion and become part of the cause of human justice, to leave this point, literature has lost an effective way of acting on the cause of justice and methods.
