确定使用作品的付酬标准对于保护作者的利益,促进文化产业的发展有着重要的意义。然而,我国著作权法关于使用作品付酬标准的规定并不明确,有关约定付酬标准和法定付酬标准的规定都存在不足之处,这不利于保护作者的利益。我国应在修订《中华人民共和国著作权法》时明确规定作者有权获取合理的报酬,增加作者的报酬修改权、查账权,详细规定合理报酬的支付方式,制定统一的使用作品付酬标准条例,设立付酬仲裁机构以裁决付酬标准,加强对著作权集体管理组织的监管。
Determining the remuneration standard of using works is of great significance for protecting the interests of authors and promoting the development of cultural industries. However, the provisions of the copyright law of our country on the use of the payment standard for works are not clear. The stipulations on the agreed standard of remuneration and the statutory remuneration standard all have shortcomings, which is unfavorable to the protection of the author’s interests. When amending the Copyright Law of the People’s Republic of China, our country should explicitly stipulate that the author has the right to obtain reasonable remuneration, increase the author’s rights of remuneration modification and checking, stipulate in detail the payment method of reasonable remuneration, formulate a unified standard for remuneration for the use of works, Set up pay tribunals to decide remuneration standards and strengthen the supervision over copyright collective management organizations.
