初二《思想政治》下册(山东版)第20页有这样一道题:未经本人同意而使用公民的肖像,属于侵犯公民的肖像权。题目要求判断此观点是否正确,并说明理由。教参提供的答案为观点错误。我认为此题所涉及的是如何分清对肖像权的侵害和肖像的合理使用这一问题,教参的判断过于绝对,应视不同情况分别加以判断。根据课本的讲述,所谓肖像权,是指公民对自己的肖像享有的拥有、使用或许可他人使用的权利。为了国家、社会利益和不以营利为目的使用他人的肖像,即使未经本人同意,也不构成对肖像权的侵
