台湾的“国际空间”一直都是两岸的焦点议题。在马英九执政后,台湾方面呼吁两岸在“建立互信、搁置争议、求同存异、共创互赢”的基础上就台湾“国际空间”进行协商。大陆方面也以善意回应,多次在官方场合表示愿意协商台湾的“国际空间”问题。本文分析了台湾加入政府间国际组织与大陆宪法的合宪性,继而探讨了台湾现存的政府间国际组织成员资格,以及现有加入模式,在此结论下,构建了台湾在政府间国际组织中的理性模式,以期对两岸在该议题的后续制度性构建有所启发。
Taiwan’s “international space” has always been the focus of cross-Strait issues. After Ma Ying-jeou came to power, Taiwan urged the two sides of the Strait to hold consultations on Taiwan’s “international space” on the basis of “building mutual trust, shelving controversy, seeking common grounds while reserving differences, and building win-win cooperation.” The mainland side also responded with goodwill. On many occasions, it has expressed willingness to consult Taiwan’s “international space” on official occasions. This article analyzes the constitutionality of Taiwan’s participation in intergovernmental organizations and the constitution of the mainland, and then explores the membership of Taiwan’s existing intergovernmental organizations and existing joining modes. In this conclusion, Taiwan has been established as an intergovernmental organization With a view to enlightening the follow-up systematic construction of the two sides across the Taiwan Strait.
