政府作为在环境治理领域的主要力量,在取得一系列治理成绩的同时也出现了一些问题:各级政府职能设置的“职责同构”现象仍然存在,政府各部门之间的环境治理职能交叉现象突出;一些环境治理政策在执行中出现偏差,总量控制制度执行力度不够,环境影响评价制度的作用受限等;社会多元主体对政府环境治理的监督与制约效果仍不明显。文章主要对政府环境治理中出现的问题从静态的职能设置到动态的环境治理及监督出现的法律问题进行分析,从法律的层面上探寻产生这些问题的深层次原因,并提出完善政府环境治理的建议。
