网络著作权的讨论,是由“网上传书”是否合法引起的。为此,中国作家协会作家权益保障委员会和中国版权保护中心于1999年12月联合召开了一次讨论会,专门讨论“网上传书”是否合法的问题。作家张洁、莫言、毕淑敏、吴越、老舍的女儿舒济(版权继承人)及有关专家、官员等十多人出席了会议。在那个会上,作家和律师以及政府官员们的观点基本上一致,只有我一个人持有不同的看法。我认为:第一,网上传书以服务网友为目的,不是营利的手段,具有网上图书馆的性质,不应该视其为侵权。图书馆可以由国家办,可以由机关、学校、厂矿等单位办,也可以由私人办。何况在网站上开办图书馆是否属于侵权行为,我国的版权法中还没有明确的规定。第二,在屏幕上读书并不方便,短文章,下载以后在屏幕上看看也
The discussion of online copyright is caused by the fact that “online book transfer” is legal. To this end, the Writers’ Association of China Writers Rights Protection Committee and the China Copyright Protection Center jointly held a seminar in December 1999 to discuss the issue of whether the “online book distribution” is legal. Moreover, it is an infringement if the library is set up on the website. There is no clear stipulation in our copyright law.
