古希腊悲剧作为一种民主政治自我完善机制的文学素材,其间蕴藏着极为丰富的法学思想资源。通过逐段疏解经典悲剧《安提戈涅》,我们将领会到诗人索福克勒斯在其中所展现的启蒙意蕴与民主政治的内在困境。这诱使我们在现代性语境下去思考启蒙的性质、人为立法与传统礼法的关系以及民主制下人的处身境遇,并最终回到立法者的德性这一古典智慧的核心关切问题;进而探明审慎、传统之于高贵民主制不可或缺的重要作用。
Ancient Greek tragedy as a democratic political self-improvement mechanism of literary material, during which contains a very rich resources of legal thought. By piecemeal interpretation of the classic tragedy “Antigone,” we will appreciate the enlightenment implied in the poet Sophocles and the inner predicament of democratic politics. This tempts us to think about the nature of enlightenment, the relationship between man-made legislation and traditional law and order, and the personal experience of a person under the influence of democracy in the context of modernity and eventually return to the core concern of the classical wisdom of the legislator. Examine prudence, the tradition of the noble democracy is an indispensable important role.
