犯罪构成理论,一直备受我国刑法学者们的关注。本文通过比较“维持派”和“重构派”的观点,对我国犯罪构成的四要件进行分析,从而提出了一些完善我国犯罪构成理论的建议。
Criminal theory has always been the concern of criminal law scholars in our country. This article analyzes the four elements of the constitution of crime in our country by comparing the perspectives of “maintaining the school” and “reconstructing the school”, and puts forward some suggestions to improve the constitution of our country’s crime.
