《侵权责任法》是一部通过对民事主体合法权益予以保护,对侵权责任予以明确,对制裁侵权行为予以强化,来推进和保障社会稳定和谐的民事基本法律。我国民法通则、消费者权益保护法、产品质量法、环境保护法、道路交通安全法等法律对侵权责任作了一些规定,这些规定对于保护公民、法人的合法权益,维护社会秩序,起到了积极作用。本文从《侵权责任法》对原来侵权责任的修改以及新规定两方面分析侵权责任法的亮点,以帮助更多的人理解运用这部新法。
The Tort Liability Act is a basic civil law that promotes and guarantees social stability and harmony through the protection of the legitimate rights and interests of the civil subject, the clarification of the tort liability, and the reinforcement of sanctions and infringements. China’s General Principles of Civil Law, the Law on the Protection of Consumer Rights and Interests, the Law on Product Quality, the Law on Environmental Protection and the Law on Road Traffic Safety have made certain provisions on tort liability, which have played a positive role in protecting the lawful rights and interests of citizens and legal persons and in maintaining social order effect. This article from the “Tort Liability Act” to amend the original tort liability and the new provisions of two aspects of Tort Liability Analysis highlights to help more people understand the use of this new law.
