近年来,S公司与C公司在全国各地提起上百起诉讼,江苏省高院判决S公司为非法集体管理组织,成为国内首例非法集体管理司法判例。与代理人不同的是他们或多或少的拥有部分著作权权利,称为排除在集体管理组织之外的非会员。现有的集体管理机制难以约束上述营利性公司的行为,为了让合法的权益得到保护。笔者认为可以规范S公司与C公司的集体管理行为,发展成为在卡拉OK行业可供非会员进行权利保护的选择途径,便于发挥其市场竞争力,落实权利保护的优势,并结合现有的集体管理组织的优势,形成以非会员自由选择为基础集体管理组织的辅助性形式。
