法科学生的司法文书写作能力系法律人必须具备的。但教学中却反映出学生在文书写作训练中普遍存在法律关系把握不到位,语言表述不规范,文书架构不合理等问题。这些问题与现有的教学方法和模式密切相关。具体而言,诉讼材料不完整,现场情景缺乏,教学方法生硬等都是教学中存在的问题。因此,必须改变现有教学模式,将纵向教学法、诊断教学法、对比教学法引入司法文书写作的教学,充分运用现代教学手段,才能有效提升学生的文书写作能力。
The legal writing ability of law students is necessary for law students. However, the teaching reflects the common problems that the students are unable to grasp the legal relationship in the training of writing instruments, the language is not standardized and the structure of the clerical system is not reasonable. These problems are closely related to the existing teaching methods and modes. Specifically, the litigation materials are incomplete, the scene scene is lacking, teaching methods are hard and so are all problems in teaching. Therefore, it is necessary to change the existing teaching mode, to introduce the vertical teaching method, the diagnostic teaching method and the comparative teaching method into the teaching of judicial document writing and make full use of the modern teaching methods so as to effectively enhance students’ ability of writing instruments.
