第四节证明宅基地使用权的主要证据一、宅基地使用权的概念及法律特征宅基地使用权是指农村集体经济组织内部成员,经批准与集体土地所有者通过签定协议的方式依法取得供自己建设住宅使用的农村集体土地使用权。宅基地使用权具有以下法律特征:(一)宅基地使用权人依法对集体所有的土地享有占有和使用的权利,有权自主利用该土地建造住房及其附属设施。
