《生命在于静止》,(简称静止)89年3月由山西人民出版社出版,署名张文江、常近。90年9月,常近向法院起诉张文江,称:《静止》由其单独完成,为报答张过去的治病之恩(诊费已付),和张共同署名,但张藏匿了原始底稿;现张要求一半稿费,并对外宣称,此书由张创作,常反作了些辅助工作。常要求法院确认《静止》为其独创作品。张文江辩称:他是《静止》的“主稿人”,完成全书77.7%。原始底稿被常取走。被告是《静止》的署名者。我国《著作权法》第十一条:”如无相反证明,在作品上署名的公民、法人或者非法人单位为作者。”原告要求法院确认被
