对商业标识进行反不正当竞争法的保护既符合该法法益保护的传统禀性,也是对商标法保护法定主义的有益补充。《反不正当竞争法》在此次修订时可以考虑引入“商业标识”的概念,并以此为依托来构建整个市场混淆行为规制框架,这对构建商业标识的反不正当竞争法保护体系具有重要意义。《送审稿》第5条对“商业标识”的引入正是实践此种理念的具体表现。但是,审订中的《修订草案》却改变了此种规定,仍然延续了现行法以列举具体标识为中心的保护方式,这并不当然构成一种进步。《送审稿》第5条和《修订草案》第6条的内容仍然值得商榷,需要进一步对注册商标保护进行知名性条件限定、在市场混淆规制条款中规定不构成混淆的例外情形及对个别立法措辞进行准确表达,以实现条文的完善。
