建构“制度笼子”不仅仅是健全权力运行的制约和监督体系问题,也是实现国家治理体系和治理能力现代化的问题,关系到国家顶层设计之问题。运用历史唯物主义的新形态——卢卡奇社会存在本体论的三大方法论原则对建构“制度笼子”的困境进行剖析,从权力、司法和伦理三个纬度探析困境之源,寻找建构“制度笼子”的路径、原则和“制度笼子”的灵魂。“制度笼子”绝不是只有钢性的带高压电的铁笼子,而是既有钢性又有软性的三层叠式结构的笼子,软性的伦理道德处于笼子的最里面属于第一层约束力,钢性的权力处于笼子的中间属于第二层约束力,带高压电的钢性司法处于笼子的外面属于第三层约束力。
Constructing a “system cage” is not only a matter of perfecting the system of control and supervision over the running of the power, but also the realization of the modernization of the state governing system and governance capacity and the issue of the top-level design of the country. Applying the Three New Methods of Historical Materialism - Lukachi’s Three Methodological Principles of Ontology of Social Being to Analyze the Dilemma of Constructing the “Institutional Cage” and Analyzing the Sources of Dilemma from Three Dimensions: Power, Judicature and Ethics and Looking for Construction “System cage ” path, principle and “system cage ” soul. “Institutional Cage ” is by no means a steel caged cage with high-voltage electricity but rather a steel cage with a three-tiered structure that is both steel and soft. The soft ethics lies in the innermost part of the cage. A layer of binding, rigid power in the middle of the cage belongs to the second layer of binding, with high-voltage electrical steel outside the cage belonging to the third binding.
