标准中专利披露是标准化组织知识产权政策的核心制度。披露制度的建立健全和执行成效将直接影响标准制定中的信息决策与顺利实施。本文从国际标准化组织的政策发展趋势梳理专利信息披露制度的产生原因,结合我国电子信息领域标准制定及信息披露现状,剖析专利信息披露制度所存在的问题,并从政策、司法和行业执行等层面思考下一步的完善措施。
Standard patent disclosure is the core of the standardization organization’s intellectual property policy. The establishment and implementation of the disclosure system will directly affect the decision-making and smooth implementation of information in standard setting. This paper analyzes the causes of the patent information disclosure system from the policy development trend of the International Organization for Standardization (ISO), analyzes the problems existing in the patent information disclosure system combining with the standardization and disclosure of information in the field of electronic information in our country. From the aspects of policy, administration of justice and industry implementation, Consider the next step to improve measures.
