行政强制执行权的法律归属问题一直都是学者们争论不休的话题,伴随着《行政强制法》的出台,该问题又再次成为了行政学界争论的焦点。根据《行政强制法》的规定看出,我国行政强制执行权的分配机制基本上沿用了原来的模式,即以行政机关申请人民法院强制执行为原则,以行政机关自力强制执行为例外。该配置方式固然有它合理的一面,本文将从行政强制执行权的性质、行政与司法角色定位、合理利用司法资源和提高行政效率等多重视角来探讨与分析该分配模式存在的争议与不足,并进而提出自己的修改建议。
The issue of law attribution of administrative enforcement power has always been a topic of constant debate among scholars. With the introduction of the “Administrative Coercion Law,” this issue has once again become the focus of controversy in the administrative field. According to the provisions of the “Administrative Enforcement Law”, the distribution mechanism of administrative enforcement power basically follows the original model, that is, the principle of applying for the enforcement of the people’s court by the administrative organ and the exception of the self-enforcing execution of the administrative organ. Although this configuration has its reasonable side, this article will discuss and analyze the controversies and shortcomings of the distribution model from multiple perspectives, such as the nature of administrative enforcement power, the position of administrative and judicial functions, the rational use of judicial resources and the improvement of administrative efficiency. And then put forward their own suggestions for changes.
