阿列克西的《基本权利论》一书对宪法基本权利的规范结构与适用方式有着独到的见解。其认为,基本权利在性质上属于原则,而作为原则的基本权利是一种最佳化命令,即要求在事实与法律上可能的范围内尽最大可能被实现。事实上的可能指涉原则实际可适用的范围,法律上的可能则要求权衡相冲突的不同原则,并划定各自的适用范围。为此,阿列克西通过比例原则的三个子原则以及重力公式来加以精确化。这一思路体现了一种建立“柔性价值秩序”的主张。
Alexei’s “Theory of Fundamental Rights” has a unique view on the normative structure and application of fundamental constitutional rights. In its view, fundamental rights are principles in nature, and the fundamental rights as a principle are an order of optimization that calls for the fullest possible realization, to the extent practicable in fact and law. In fact, it may refer to the range of practical application of the principle, while legal possibility calls for weighing the different principles of conflict and delineating their respective scope of application. For this reason, Alexei is refined by the three sub-principles of the principle of proportionality and the formula of gravity. This thinking reflects a proposition of establishing a “flexible value order.”
