国有大型施工企业普遍按《公司法》要求进行了公司制改造,构建了企业集团,初步改变了过去以行政隶属关系为支撑的多级法人格局。集团公司与各子公司之间的关系已经变为以资产为纽带的产权关系。应该说,集团母子公司的关系理论上是明确的,但在实际工作中,二者关系的处理尚存在诸多问题,严重影响了集团整体优势的发挥,投资者的权益也难以得到保证。
