新证据不仅决定着一场诉讼的胜负,也决定着一场诉讼在什么时候停下来。我国《民事诉讼法》第一百七十九条规定,当事人有新的证据,足以推翻原判决、裁定的,其申请再审,人民法院应当再审。可见只要有足够的新证据,就能够引起再审程序,也能够推翻原审的判决、裁定。那么什么证据是新证据?法院在审理中又依据什么原则来确认?我国相应的法律规定却很少,几乎是空白。司法实务中各地的标准也不一致,比较混乱。这极大的影响了人们对法律的信仰。
The new evidence not only determines the outcome of a lawsuit, but also determines when a lawsuit will be stopped. Article 179 of China’s “Code of Civil Procedure” stipulates that if the parties have new evidence that can overthrow the original verdicts and rulings, the application shall be retrial and the people’s court shall retrial. Visible as long as there is enough new evidence, can cause retrial procedures, but also be able to overthrow the original trial verdict. So what evidence is new evidence? Court in the trial and according to what principles to confirm? Our corresponding laws and regulations are seldom, almost blank. Judicial practice in different parts of the standard is inconsistent, more confusing. This has greatly affected people’s belief in the law.
