面对市场经济体制下日益复杂的经济关系和劳动关系 ,工会要履行好维护职工合法权益的基本职责 ,在很大程度上取决于自身的维权能力和水平。而目前我国工会维权存在理论研究滞后和体制上的障碍。工会维权必须走社会化、法治化、制度化之路 :(1)积极调整党政与工会的关系 ,推动工会的职业化、社会化和行业化 ;(2 )增强工会集体谈判能力 ;(3 )从法律上保障工会的独立性 ,增强工会的协调能力 ;(4 )加快现代企业制度改革 ,健全职工代表大会制 ;(5 )把工会纳入现代民主治理的范畴 ,促进公民社会形成。
Faced with the increasingly complex economic relations and labor relations under the market economy system, the trade unions must fulfill their basic duties of safeguarding the legitimate rights and interests of workers and staff members largely depend on their own ability and level of safeguarding their rights. At present, there exists a theoretical study of the rights protection of trade unions in our country lagging behind and institutional obstacles. (1) Actively adjust the relationship between the party and government and trade unions and promote the professionalization, socialization and industrialization of trade unions; (2) Enhance the collective bargaining power of trade unions; (3) (4) speeding up the reform of the modern enterprise system and perfecting the system of workers’ congresses; (5) incorporating the trade unions into the category of modern democratic governance and promoting the formation of civil society.
