知情权作为传统消费者九大权利的基础性权利,其实质是运用法律手段克服和矫正信息不对称的产物。鉴于金融消费不同于日常其他消费,其呈现出信息的虚拟性、专业性、交易风险的扩散性等特征,使得传统知情权的保护手段面临极大的适用性难题。因此,要建立一套保护金融消费者知情权的专门机制,首先要解决的是金融消费中存在着的信息不对称,所以解决当前金融消费者知情权保护存在着的困境是其关键。
As the basic right of the nine major rights of the traditional consumers, the essence of the right to information is to use legal means to overcome and correct the asymmetric information products. In view of the fact that financial consumption is different from other daily consumption, it shows the characteristics of information virtuality, professionalism and transactional risk diffusion, which makes the traditional means of protection of intellectual property right facing great applicability problems. Therefore, to set up a special mechanism to protect the financial consumers ’right to know, the first problem to be solved is the asymmetric information existing in the financial consumption. Therefore, it is the key to solve the current predicament of financial consumers’ right to information protection.
