事业单位推行聘用制改革以来,聘用合同的法律性质一直争论较大、无法达成共识,对聘用合同签订主体法律地位的认识模糊是造成这种现象的一个重要原因。通过对我国人事关系变革的历史梳理以及现行聘用合同立法及政策的分析,明确事业单位为政府授权的公益服务法人,事业单位在编职工为政府及事业单位的双重雇员,二者之间是一种兼具“行政性”和“从属性”特殊人事关系。基于这种认识,通过对合同主体的剖析及现行法律法规的分析,明确聘用合同的法律性质为复合合同。
