西方的检察制度经历了由国王诉讼代理人到公共利益代理人的这样一个转变历程,逐渐成立了独立的检察机关,形成了自上而下的完整体系。这种演变的特点在于从监督职能到公诉职能的转变,从代表国王利益到代表公共利益的转变,从从属机构到独立机关的转变,从身份多重性到身份单一性的转变。借鉴西方检察制度发展的经验,有利于我国更好的完善检察制度。
The prosecutorial system in the West experienced such a course of change from a lawsuit agent at the king to a public interest agent and gradually formed an independent procuratorial organ and formed a complete top-down system. This evolution is characterized by a shift from a supervisory function to a public prosecutorial function, a change from representing the interests of the king to representing the public interest, a change from a subordinate body to an independent body, a change from the multiplicity of identities to the unitary identity. Learn from the experience of the development of the western prosecutorial system is conducive to our country to better improve the procuratorial system.
