劳动关系的稳定是社会关系稳定的大前提,为保障劳动关系的稳定,就需要限制用人单位任意解除或者终止劳动关系的权力,反映在法律规定上就是在解除或者终止劳动关系的时候,用人单位需要支付劳动者一定的经济补偿。但是又并非所有的解除或者终止劳动关系的情形,劳动者都能得到经济补偿;并且经济补偿的具体计算方法和基数也因为情形的不同而存在差别。为了厘清实践中劳动者的计算误区,北京市海淀区法院的法官通过案例就如何正确计算自己应该获得的经济补偿给予详细解释。
