前不久,淄博市人大常委会公布了《淄博市劳动合同条例》,自2001年1月1日起施行。这是淄博市获得地方立法权后出台的第一部劳动保障地方性法规,标志着淄博市劳动保障法制建设迈上了一个新的台阶。《条例》从适用范围,劳动合同订立必备条件,劳动合同履行、变更、解除、终止条件及限制条件,解除劳动合同经济补偿,劳动合同管理和劳动争议处理,法律责任等方面作了规范,使劳动关系的调整有了具体的地方性法规依据。该《条例》在保持与《劳动法》和有关行政法规、规章一致性的基础上,充分体现了地方特色,其持点可归结为“八个突出”:一是突出了社会反映强烈的问题。对用人单位非法强制劳动者集资、入股、缴纳抵押性钱物和扣押有效证件等行为,明确作出了禁止和承担法律责任的规定;二是突出了劳动保障工作重点。增加了社会保险作为劳动合同
