《中华人民共和国物权法》(以下简称物权法)已于2007年10月1日正式实施,该法第二编第六章是规定业主建筑物区分所有权的内容,共有14个条文。其中,对近几年在物业纠纷中出现较多的问题作了明确的规定。在2007年8月26日,国务院根据物权法的规定对《物业管理条例》进行了修改。物权法的规定比较原则,对于业主之间的关系,可以通过物权法有关建筑物区分所有制度进行调整;而对于业主与物业服务企业之间的纷争,多通过《物业管理条例》进行调整;对于其中的相邻关系通过物权法及民法通则的规定进行调整。下面,笔者举例对物权法中几个新规定予以简要阐释。
The Property Law of the People's Republic of China (hereinafter referred to as the Property Law) came into effect on October 1, 2007, and Chapter VI of Part II of the Law stipulates the ownership of buildings by owners. There are totally 14 provisions. Among them, on the property disputes in recent years more problems have been made clear. On August 26, 2007, the State Council amended the Property Management Regulations in accordance with the provisions of the Property Law. Property law provisions of the principle of comparison, for the relationship between the owners, property law can be related to the structure of all buildings to make adjustments; and disputes between owners and property service enterprises, through the “Property Management Ordinance” to adjust; of which Adjacent relations through the Property Law and the provisions of the General Rules of Civil Law to adjust. Below, I give an example of several new provisions of the Property Law briefly explain.
