“实封投状”是宋代官田宅买卖、租赁及官营工商业经营权转移中出现的一种法定竞争形式,是类似于现代招标、投标的竞争机制。本文主要探讨了宋代“实封投状”法的适用范围、运行程序和保障措施。本文认为:此项法制虽然是以实现国家利益最大化为宗旨,但其展现的追求公开、公平、机会均等的法定形式和创新精神,在一千年前的世界上是独一无二的。对今天规范市场经济中的公平竞争,也不无裨益。 “Seal” is a statutory form of competition that appears in the transfer of commercial houses, leases and commercial and industrial management of government-owned houses in the Song Dynasty. It is a competition mechanism similar to modern bidding and bidding. This article mainly discusses the application scope, operational procedures and safeguards of the Song Dynasty Law of the People. This article argues that although this legal system is aimed at maximizing national interests, its legal form and innovative spirit of pursuing an open, fair and equal opportunity are unique in a thousand years ago in the world.
