鉴于目前境内LGBT〔1〕群体在职场中遭受普遍的歧视而反歧视立法缺失,本文对我国香港、澳门、台湾地区以及美国、英国、菲律宾相对完善的反就业歧视法进行比较研究。本文主要通过文献研究结合个案访谈的方法探究这些地区和国家反就业歧视法中对LGBT群体保护的立法概况和法律框架,相关法律如何对LGBT进行立法保护以及立法实施情况等。旨在梳理总结所研究地区和国家相关反就业歧视法的特点,以推进我国涉及LGBT人群的反就业歧视立法。 In view of the current domestic LGBT 〔1〕 groups suffer widespread discrimination in the workplace and the lack of anti-discrimination legislation, this article comparative study of the relatively perfect anti-employment discrimination law in Hong Kong, Macao, Taiwan and the United States, Britain, the Philippines. This article mainly investigates the legislative outline and legal framework for the protection of LGBT people in the anti-employment discrimination law in these regions and countries through literature research combined with case-based interviewing, and the relevant laws on how to protect the LGBT legislation and the implementation of the legislation. The purpose of this study is to summarize the relevant anti-employment discrimination laws in the regions and countries under study in order to promote anti-employment discrimination legislation in China involving LGBT people.
