一、问题的提出客户资料(client information)是指经营者在经营活动中所形成的记载着其客户资源的信息和知识,在形式上表现为客户档案和客户名单等。一般认为,客户资料属于商业秘密的一种,受到竞争法的保护。在我国《反不正当竞争法》及其解释和国家工商局的有关规定中,客户资料都被视为商业秘密中的经营信息。美国早在1939年的《侵权行为法重述》中就指出,商业秘密“甚至可以是一张客户名单”。 1995年美国《反不正当竞争法重
