植物新品种的培育不仅关系着培育人的利益,更影响着农业的发展,关系民生。植物新品种得到有力的保护,将激发品种培育者等入更多的人力物力用于开发和推广新品种。目前,我国《植物新品种保护条例》对已获得授权的植物新品种给予了品种权保护,但对于申请期品种没有进行明确规定。申请期品种只要符合认定新品种的条件,同样具有巨大的商业价值。因此,本文将展开论述,阐明对申请期新品种进行保护的必要性,并提出相应的建议和对策,以供完善我国植物新品种权保护制度。
The cultivation of new plant varieties not only concerns the cultivation of human interests, but also affects the development of agriculture and the relationship between people’s livelihood. Plant new varieties have been effectively protected, will stimulate the breeder and other more into the human and material resources for the development and promotion of new varieties. At present, China’s “Regulations for the Protection of New Varieties of Plants” grant variety rights protection to newly licensed plant varieties, but there is no explicit stipulation on the varieties of the application period. As long as the application of the species eligible for identification of new varieties of the same great commercial value. Therefore, this article will expand the discussion to clarify the need for the protection of new varieties of the application period, and put forward corresponding suggestions and countermeasures for the improvement of China’s plant variety rights protection system.
