作为一种源自发达国家的文化,现代法律文化通常具有三个显著特征。第一个特征是它尤为强调人权。在这些社会中,人权意识是一种普遍的社会事实。这种意识蕴含着人们对于人权的实施吁求着某种机制,诸如权利法案的激增、宪法和司法审查制度等。第二个核心特征是对个人自由选择的强调和重视。第三个特征是趋同,即基于相似的问题和相似的文化,发达国家的社会和法律正逐渐变得越来越相似。我们确实无法预知这种趋势在未来的可能走向。
