以突尼斯爆发的“茉莉花革命”为导火索,北非地区进入了三十多年来罕见的政治动荡期。作为中国对外承包工程业务的重要市场之一,利比亚的问题显得尤为突出。这必将导致当地的中国国际工程承包企业面临较大的经济损失,因此尽可能减少损失是目前迫切需要解决的问题,弥补或减轻这些损失的直接方式就是向业主索赔。本文分析了中国国际工程承包商在利比亚项目中面临的索赔问题,帮助承包商合理索赔,维护自身经济利益,也为承包商以后解决类似问题提供借鉴。
In the wake of the “Jasmine Revolution” in Tunisia, North Africa has entered a period of rare political turmoil in more than 30 years. As one of the important markets for China’s overseas contracted projects, the issue in Libya is particularly prominent. This will surely cause the local Chinese international engineering contracting enterprises to face greater economic losses. Therefore, it is an urgent issue to minimize the losses so far. The immediate way to make up for or alleviate these losses is to claim compensation from the owners. This article analyzes the claims that Chinese international engineering contractors face in the Libya project, helps the contractors to make reasonable claims and defends their own economic interests, and also provides references for the contractors to solve similar problems in the future.
